A Pre-Nuptial Agreement sets out how a couple wish to divide their matrimonial property should the marriage end in divorce. A Post-Nuptial Agreement is similar, the difference being that it is agreed after the wedding has taken place rather than before. Although Nuptial Agreements are not technically legally binding, if both parties have received independent legal advice and the agreement is fair, the Courts are likely to uphold it.
